Article 12 Human Resources
1. For the development of the institutional responsibilities of the Agency shall provide itself with its own technical staff, administrative and labor in respect of staffing, which was approved by the Regional Council on a proposal of the Director General in consideration of the term employment and initial framework set out in the following paragraphs and Article 16, paragraph 5.
2. When first established, the Agency relies on:
a) role of workers and the workers and employees for an indefinite period employed by the Region Apulia, already employed to forestry and irrigation, passing employed by the Agency under Article 31 of Legislative Decree 31 March 2001, No 165 (General Rules on the organization of employment by the government);
b) of forest and agricultural seasonal workers already employed fixed-term employed by the Puglia Region for the development of forestry and irrigation transferred to the Agency , under the right of way referred to in paragraph 4d Article 5 of Legislative Decree 6 September 2001, No 368 (Implementation of Directive 1999/70/EC concerning the Agreement framework agreement on fixed-term work concluded by UNICE, CEEP and the ETUC), as inserted by paragraph 1 of Article 40 of Law 24 December 2007, n. 247, apart from the instance of e in subsection 4 of that article, as added by paragraph 1 of Article 40 of Law 247/2007.
To this end, the Agency works in the year 2010, the conversion from temporary to permanent employment relationships of the seasonal forestry workers through their use for a period equal to or greater than centottantuno working days, to ensure the consolidation and improvement of the activities referred to in Articles 2 and 3.
Similarly, the Agency operates, from the year 2010 and until 2012, the gradual transformation from fixed-term permanent employment relationships of irrigated seasonal workers, through their use for a period gradually increased until it achieved a centottantuno or more working days, at the enlargement and improvement of services and activities referred to in Articles 2 and 3 and the integration of land-based activities with those of irrigated forest.
The transformation of employment under this letter operates solely on irrigation and forestry workers during the year 2009 had provided employment for not less than seventy working days, or for forest workers and that irrigation during the three years prior to the year 2009 had provided employment for not less than seventy working days per year; c) of officials of the region, former employees organization and administration of forestry and irrigation carried out by the Region of Puglia and transferred to the Agency through the institution of the posting. These employees continue to benefit from salaries, and essential accessory in enjoyment at the expense of the regional budget.
3. The staff worker of the Agency shall apply the national collective agreement for employees in the work of accommodation hydraulic-hydraulic-forestry and agriculture with the consequent application of the relevant legal and economic treatment and insurance-insurance pursuant to Article 1, Section 14 of Decree-Law 1 October 1996, No 510 (Urgent provisions of socially useful work, interventions to support income and social security sector), with amendments, into law November 28, 1996, No 608.
the remaining staff of the Agency, including the regional workers already assigned to the lists referred to in subparagraph a) of subsection 2 and subject to the provisions of paragraph 5, subject to the legal status and contractual arrangements for employees in regions and local governments and is confirmed the right of return in to change the legal nature of the Agency.
4. In the first classification in the national collective agreement for employees in the work of hydraulic-hydraulic-forestry and agriculture, irrigation workers for an indefinite period under paragraph 2, letter a) and irrigation workers under fixed-term paragraph 2, letter b), are classified as laid out in the equation. Nothing has changed for forest workers referred to in paragraph 2, letter b), compared to the frameworks already in place at the Region of Puglia.
5. Until the definition of staffing, the role of workers employed by the Region of Apulia passed Agency under paragraph 2, letter a) shall be classified, upon request, a national collective agreement for employees in the work of hydraulic-hydraulic-forestry and agriculture with the consequent application of the relevant legal and economic treatment and insurance-pensions .
